Claire Ashton Lifestyle Management

| These Terms & Conditions apply to services supplied by Claire Ashton Lifestyle Management, including 1:1 coaching, Personal Training, memberships, online programmes and challenges. They are designed to explain clearly how the services work and what both Claire and the client can expect. |
1. About these terms
These Terms & Conditions form part of the agreement between you and Claire Ashton Lifestyle Management when you purchase or use a paid service. The details of the particular service you purchase, including its price and what is included, will also form part of that agreement.
Claire Ashton Lifestyle Management is operated by Claire Ashton as a sole trader. Public-facing services may be marketed under the name Claire Ashton Coaching.
Nothing in these Terms & Conditions affects any statutory rights that you have as a consumer.
2. Services and professional scope
Coaching
Coaching is a collaborative process intended to support you in exploring goals, choices, habits, confidence and wellbeing and in identifying actions that are appropriate for you. Coaching is not psychotherapy, counselling, psychiatric care, medical treatment or a substitute for regulated healthcare.
Claire does not diagnose or treat physical or mental health conditions within her coaching role. Although Claire is also a qualified cardiac nurse, purchasing coaching or Personal Training does not create a nurse-patient relationship. Where something falls outside Claire’s professional scope, she may recommend support from an appropriately qualified professional and may pause or end coaching if continuing would not be appropriate.
Eating disorders and disordered eating
Coaching around food, body image and movement is not a substitute for specialist eating disorder assessment or treatment. Claire does not diagnose or treat eating disorders as part of her coaching services.
If you have an active or suspected eating disorder, or concerns arise during coaching that may require specialist support, Claire may recommend that you speak to your GP or an appropriately qualified eating disorder professional. Depending on your circumstances, coaching may be able to continue alongside appropriate specialist support. Claire may pause or end coaching where continuing would be outside her professional scope or inappropriate for your needs.
Nutrition information and support
Where relevant, Claire may provide general nutrition education and practical support around areas such as balanced eating, protein, meal patterns and everyday food choices. This is general health and wellbeing education and support, not individualised dietetic treatment, prescriptive nutritional therapy or a therapeutic diet.
Claire does not diagnose or treat nutritional or medical conditions. Where your needs fall outside Claire’s professional scope, you may be advised to speak to your GP, a registered dietitian or another appropriately qualified healthcare professional.
Claire may invite you to keep or share a food diary to explore eating patterns, routines and practical areas for support. Food diaries are used as a coaching and educational tool, not for calorie monitoring, weight-loss tracking or clinical nutritional assessment.
3. Personal Training and health information
Before beginning Personal Training, you must complete a PAR-Q (Physical Activity Readiness Questionnaire) and provide accurate, relevant information about your health and circumstances. You must tell Claire about relevant changes to your health, medication, pregnancy, injury or symptoms before and during your work together.
Where appropriate, Claire may ask you to seek advice or clearance from an appropriate healthcare professional before beginning or continuing exercise.
Claire may modify, pause or stop a Personal Training session if she reasonably believes that continuing would not be appropriate or safe because of illness, injury, pain, symptoms or another health concern. Whether the session is rearranged or treated as used will be considered case by case.
4. 1:1 sessions
Standard 1:1 coaching and Personal Training sessions are 55 minutes unless otherwise agreed.
Booking
Sessions are arranged by mutual agreement and are subject to Claire’s availability. Regular appointment times may be agreed where possible, but they are not guaranteed permanently and may occasionally need to change. Claire will give as much notice as reasonably possible if she needs to alter an agreed appointment.
Clients are responsible for arranging and using the sessions included in their membership period. Claire will offer reasonable appointment availability, but specific days and times cannot always be guaranteed.
Cancellation and rearrangement
At least 48 hours’ notice is required to cancel or rearrange a booked coaching or Personal Training session. With less than 48 hours’ notice, the session will normally be treated as used. Claire may exercise discretion where there are genuine exceptional circumstances.
If Claire needs to cancel or rearrange a session, you will not lose it. It will be rescheduled, carried forward or, where appropriate and agreed, delivered online.
Late arrivals and no-shows
Sessions begin and end at the agreed times. If you arrive late, the session will still finish at the original scheduled time. If Claire is late, you will still receive the full 55-minute session.
For online sessions, Claire will remain on the call for 10 minutes after the scheduled start time. If you expect to join after this point, please contact Claire. If you do not attend and have not contacted Claire, the session will be treated as used.
5. Memberships
Membership period and payment
Monthly memberships run from your individual membership start/payment date to the corresponding date in the following month. Membership fees are payable monthly in advance on the agreed payment date.
Payment arrangements will be agreed when the membership begins. Where payment is made by standing order, you are responsible for setting up and maintaining the standing order for the agreed amount and date.
Minimum commitment and ending a membership
Coaching and Personal Training memberships have an initial minimum commitment of three months. After that initial period, the membership continues monthly until ended by either party.
After the minimum commitment, you may end your membership by giving one month’s notice. The membership remains active during the notice period, payment remains due, and you may continue using the sessions and support included.
Unused sessions and carry-over
Sessions are intended to be used within the relevant membership period and do not automatically accumulate. Carry-over is considered case by case. For a client holiday, up to one unused session may be carried into the following membership period where this is agreed with Claire in advance.
A membership continues as normal while you are on holiday and payments are not paused or reduced for holidays. Where a session cannot take place because of Claire’s unavailability, the session will be rearranged, carried forward or otherwise credited so that you do not lose it.
Illness, injury, pregnancy and childbirth
Short-term illness or injury is considered case by case and does not automatically pause or extend a membership.
Where a longer-term illness or injury prevents participation, a membership may be paused by agreement for up to three months. If you are unable to return after three months, the membership will normally end and you can discuss rejoining when you are ready.
Pregnancy and childbirth are treated separately. A membership may be paused for a longer period during pregnancy and following childbirth. The timing and length of the pause will be agreed individually, taking account of your circumstances and when it is appropriate for you to return. The standard three-month illness/injury limit does not apply to pregnancy and childbirth.
Changing or rejoining a membership
An upgrade to a membership with more sessions or support may be arranged subject to availability and the applicable fee. One month’s notice is required to move to a lower-level membership.
If you end a membership and later rejoin, this is subject to Claire’s availability and the membership options and prices available at that time. Previous prices, appointment times and other arrangements are not guaranteed.
Failed or overdue payments
If a membership payment fails or becomes overdue, Claire will give you an opportunity to update your payment arrangements or make the outstanding payment. Sessions and other membership support may be paused while payment remains outstanding. Repeated or unresolved non-payment may result in the membership ending.
6. Between-session support
Where your coaching or Personal Training membership includes between-session support, you may contact Claire by WhatsApp or email at any time. During normal working weeks, messages are monitored Monday to Friday and Claire will aim to respond within one working day.
You may send messages at weekends, but a response should not be expected until the next working day. If you have a scheduled Saturday session, Claire will be available for that appointment.
During Claire’s holidays or other periods of planned leave, WhatsApp and email support will remain available, but responses may take up to two working days. Clients will be informed of planned leave wherever reasonably possible.
Between-session support is intended for brief coaching, accountability, questions and practical support. It is not intended to replace a scheduled coaching or Personal Training session, and more detailed issues may be held for your next appointment. It is not an emergency, crisis or medical advice service.
7. In-person Personal Training
In-person sessions may take place at Claire’s premises, at the client’s home, outdoors, or at another location agreed in advance between Claire and the client.
Where a client requests a venue that charges an entry, hire or other access fee, any additional cost must be agreed in advance and will normally be the client’s responsibility. Sessions at third-party gyms or facilities are subject to that venue’s rules and permission for external Personal Trainers.
Travel
Travel of up to 6 miles from Claire’s premises is included in the agreed Personal Training fee. Claire may agree to travel further for an additional charge, which will be agreed before sessions are booked. Claire is not obliged to accept bookings outside her usual travel area.
If you cancel with less than 48 hours’ notice, the session will normally be treated as used. If Claire has already travelled to or arrived at the agreed location before you cancel, or it becomes apparent that you are not attending, the session will be treated as used. Any separately agreed travel costs already incurred may also remain payable.
Client’s home and interruptions
Where training takes place at your home, you are responsible for providing a reasonably safe and suitable space to exercise and for telling Claire in advance about significant space restrictions or other potential hazards. Claire may adapt, move online, rearrange or stop a session if she reasonably considers the environment unsuitable or unsafe.
If children, pets or other people are present during a home or online session, you are responsible for ensuring they do not create an unsafe environment or interfere with your ability to exercise safely. Client-side interruptions do not extend the scheduled 55-minute session, although Claire will make reasonable efforts to adapt and continue.
Claire’s premises and equipment
Where training takes place at Claire’s premises, access to the premises and equipment is provided only for the duration of your booked, supervised session. Clients do not have independent access outside scheduled appointments.
Where Claire provides equipment, you should use it as instructed and tell Claire immediately if anything feels uncomfortable, unsafe or unsuitable. Claire will take reasonable steps to ensure equipment she provides is suitable and appropriately maintained.
8. Online Personal Training and independent exercise
Personal Training may be delivered online. You are responsible for providing a reasonably safe exercise space and for using your own equipment appropriately where applicable.
Personal Training can be adapted to the equipment reasonably available to you. Claire may recommend equipment that could benefit your training, but you are not required to purchase equipment unless this has been specifically agreed as part of your service. Equipment you choose to purchase should be suitable, correctly assembled and maintained in accordance with the manufacturer’s instructions.
Independent programmes
Where Claire provides an exercise programme for you to complete independently, it will be based on the information you have provided and your circumstances at the time it is created. You are responsible for following instructions, using equipment appropriately and exercising in a suitable environment.
Do not continue an exercise if you experience pain, feel unwell or develop symptoms that concern you. Tell Claire about relevant changes to your health, injury, medication, pregnancy or circumstances so that your programme can be reviewed where appropriate.
If you return to an older programme later, you are responsible for considering whether your health, fitness, injuries or circumstances have changed. Seek updated guidance where you are unsure whether a previous programme remains appropriate.
Technical difficulties
If technical difficulties on Claire’s side prevent an online session taking place or significantly interrupt it, Claire will arrange an appropriate alternative, which may include continuing another way, rearranging the session or making up lost time. If technical difficulties occur on your side, Claire will make reasonable efforts to continue; any rearrangement or credit will be considered case by case.
9. Worksheets, resources and session summaries
Claire may provide worksheets, reflections, exercises, training programmes or other activities between sessions. These are intended to support your work together and may be based on your goals and circumstances at the time. Completion of these activities is not a guarantee of any particular result.
Claire may make confidential electronic notes during or following coaching and Personal Training sessions and may send you a summary of key points, reflections or agreed actions afterwards. You are encouraged to keep your own notes. Any summary provided by Claire is a helpful recap and should not be relied upon as a complete record of everything discussed.
10. Confidentiality and safeguarding
Information shared during 1:1 coaching will be treated as confidential and will not normally be shared with another person without your permission.
There may be limited circumstances where Claire is required or reasonably needs to disclose information, including where required by law or where there is a serious safeguarding concern involving the safety of you or another person. Where appropriate and possible, Claire will discuss this with you before disclosure.
Claire may keep appropriate confidential notes in accordance with her Privacy Policy and applicable data protection requirements.
11. Online programmes, challenges and digital content
The description, price, start date, access period and specific inclusions of an online programme or challenge will be stated on the relevant sales or checkout page.
Personal use and intellectual property
Videos, recordings, workbooks, worksheets, guides, programmes and other materials supplied by Claire Ashton Lifestyle Management are protected materials and remain the intellectual property of Claire Ashton Lifestyle Management unless otherwise stated.
Your purchase gives you permission to use the materials for your own personal, non-commercial use. You must not copy, share, distribute, reproduce, sell, upload online or provide them to another person without Claire’s prior written permission.
Live group sessions and recordings
A live group session may be recorded where this forms part of the programme. Participants will be told in advance. If you do not want your image or voice included, you may keep your camera and microphone off and, where available, submit questions privately.
A programme recording is intended for the relevant participants. Participation in a recorded session does not give Claire permission to use your image, voice or personal contribution for marketing without appropriate separate permission.
Group conduct and privacy
Participants must communicate respectfully with Claire and other group members. Abusive, discriminatory, threatening, persistently disruptive or otherwise inappropriate behaviour will not be accepted.
You must respect the privacy of other participants. Personal information, messages, images or experiences shared by another participant must not be copied, shared or discussed outside the group without that person’s permission.
Claire may remove a participant from a group, programme or challenge where behaviour seriously or repeatedly breaches these expectations. Depending on the circumstances, removal may be without a refund, subject always to statutory consumer rights.
12. Online purchases, cancellations and refunds
Where you buy a service, programme or digital content online, any statutory cancellation rights that apply to your purchase continue to apply. The checkout and order confirmation will provide the information required for the particular purchase.
Where digital content is supplied during the statutory cancellation period, you may be asked at checkout to expressly consent to immediate supply and acknowledge that, once supply begins, you lose the statutory right to cancel that digital content.
Where the required consent and acknowledgement have been obtained and digital access has begun, change-of-mind refunds will not normally be offered for that digital content simply because you do not attend, change your mind or do not complete the programme. This does not affect your statutory rights where content or services are faulty, not as described or not provided as agreed.
If Claire cancels an entire challenge or programme before it begins, purchasers will receive a full refund. If a programme has already begun and illness, emergency or another circumstance prevents Claire from delivering part of it, Claire may reasonably rearrange or postpone the affected element. If a significant part ultimately cannot be provided, an appropriate refund will be made for the part not delivered.
13. Client responsibility and results
Claire will provide the coaching, Personal Training, education, guidance and support included in the service you purchase. Coaching and Personal Training are collaborative processes. You remain responsible for your own choices, decisions and actions, including how you use information, strategies, programmes and resources.
Progress can be influenced by many factors, including health, circumstances, consistency, available time and factors outside either your or Claire’s control. Claire cannot guarantee any particular result or outcome from coaching, Personal Training, programmes or challenges. This includes changes in health, fitness, strength, confidence, body image, eating behaviours, weight or any other physical or personal outcome.
Testimonials, reviews and client experiences illustrate individual experiences and are not promises that another client will achieve the same or similar results.
14. Testimonials and marketing
Claire may invite clients to provide feedback, testimonials or reviews. Providing a testimonial is optional. Where feedback, a client story, photograph or other identifiable information is to be used for marketing, Claire will obtain appropriate permission.
Working with Claire does not automatically give permission for private coaching conversations, personal information or confidential material to be used for marketing.
15. Ending or suspending services by Claire
Claire may end a coaching or Personal Training membership by giving reasonable notice where she believes the service is no longer appropriate, falls outside her professional scope, or the working relationship is no longer suitable.
Claire may suspend or end a service immediately in more serious circumstances, including abusive or inappropriate behaviour, persistent non-payment or behaviour that makes it unreasonable or unsafe to continue. Any payment relating to services not yet provided will be dealt with fairly, taking account of the circumstances and your statutory rights.
16. Changes to fees and services
Claire may change membership fees from time to time. Existing clients will receive at least one month’s notice of a fee increase. If you do not wish to continue at the new price, you may give notice to end your membership in accordance with these Terms.
Claire may make reasonable changes to the way membership services are structured or delivered, including check-ins, resources, programmes or between-session support. Where a change materially affects what is included, reasonable advance notice will be given. Services already paid for will not be materially reduced without an appropriate alternative being offered.
17. Circumstances outside reasonable control
If an in-person session cannot reasonably go ahead because of severe weather, travel disruption or another circumstance outside Claire’s reasonable control, Claire may offer to deliver the session online where appropriate or rearrange it for another mutually convenient time. You will not lose the session in these circumstances.
18. Liability and consumer rights
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, or removes rights you have under consumer law.
You are responsible for providing accurate information relevant to the service and for following reasonable safety instructions. Claire is responsible for providing services with reasonable care and skill. These Terms do not seek to exclude responsibility for services that are not provided with the standard required by law.
19. Age
Claire Ashton Coaching services are intended for adults aged 18 and over. Claire does not currently provide coaching or Personal Training services to anyone under 18. Claire’s usual client base may be more specific than this, but the age requirement does not prevent Claire choosing whether to accept an individual adult client.
20. Privacy
Personal information is handled in accordance with the Claire Ashton Lifestyle Management Privacy Policy. This includes information provided during enquiries, PAR-Q health screening, coaching or Personal Training, session notes and communications.

21. Complaints and contact
If you have a concern about a service, please contact Claire in the first instance so that there is an opportunity to resolve it.

22. Governing law
These Terms & Conditions are governed by the laws applicable in England and Wales. Nothing in this clause removes any mandatory consumer rights relating to where you live or your right to bring proceedings in a court that consumer law allows.
